This Acceptable Use Policy ("AUP") governs the use of the dbl9 Platform platform and services (the "Service") provided by dbl9 GmbH ("dbl9"). This AUP is incorporated into and forms part of the dbl9 Terms of Service ("Agreement"). Capitalized terms not defined herein have the meanings given in the Agreement.
By using the Service, you agree to comply with this AUP. Any violation of this AUP may result in the suspension or termination of your access to the Service.
1. GENERAL CONDUCT
You agree to use the Service only for lawful purposes and in accordance with the Agreement and this AUP. You are responsible for ensuring that all Authorized Users comply with this AUP.
2. PROHIBITED USES
You may not use the Service, or permit any third party to use the Service, to:
2.1. Illegal Activities
(a) Violate any applicable local, state, national, or international law, statute, regulation, or ordinance.
(b) Engage in, promote, or facilitate any illegal activity, including but not limited to fraud, money laundering, financing of terrorism, or trafficking.
(c) Violate any export control, sanctions, or trade compliance laws or regulations.
2.2. Harmful or Abusive Content
(a) Store, transmit, distribute, or make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
(b) Store, transmit, or distribute any content that exploits or endangers minors in any way, including but not limited to child sexual abuse material (CSAM).
(c) Store, transmit, or distribute content that incites violence, hatred, or discrimination against any individual or group based on race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or any other protected characteristic.
(d) Create, distribute, or facilitate the creation of deepfakes, synthetic media, or other AI-generated content designed to deceive, defraud, or mislead.
2.3. Intellectual Property Violations
(a) Infringe or misappropriate any third party's intellectual property rights, including copyrights, trademarks, trade secrets, or patents.
(b) Use the Service to store, distribute, or facilitate the distribution of pirated content.
2.4. Security Violations
(a) Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service, through hacking, password mining, social engineering, or any other means.
(b) Introduce viruses, trojan horses, worms, spyware, malware, or any other malicious or harmful code or technology.
(c) Conduct vulnerability scanning, penetration testing, or security assessments of the Service without dbl9's prior written authorization.
(d) Interfere with, disrupt, or create an undue burden on the Service or the networks or infrastructure connected to the Service, including through denial-of-service attacks.
(e) Circumvent, disable, or otherwise interfere with any security features, access controls, or usage limitations of the Service.
2.5. Spam and Unsolicited Communications
(a) Use the Service to send unsolicited bulk messages (spam), phishing messages, or other deceptive communications.
(b) Harvest or collect email addresses or other personal information of third parties without their consent.
2.6. AI-Specific Restrictions
(a) Use AI Features to generate content intended to mislead, deceive, or defraud any person, including impersonation of real individuals.
(b) Use AI Features to generate content that constitutes legal, medical, financial, or other professional advice without appropriate disclaimers and human oversight.
(c) Use AI Features to make fully automated decisions that have legal or similarly significant effects on individuals without adequate human review.
(d) Use AI Features to develop or operate weapons systems, surveillance tools targeting individuals based on protected characteristics, or systems designed to manipulate human behavior in harmful ways.
(e) Systematically extract, scrape, or harvest AI model weights, parameters, or training data from the Service.
(f) Use AI Features to circumvent or attempt to circumvent safety measures, content filters, or other protective mechanisms of the Service.
(g) Use AI Features in a manner that violates the EU AI Act, or any comparable AI-specific regulation applicable to your use.
2.7. Resale and Unauthorized Access
(a) Resell, redistribute, sublicense, or otherwise make the Service available to any unauthorized third party.
(b) Use the Service to build or operate a product or service that is substantially similar to or competitive with the Service.
(c) Use the Service for benchmarking or competitive analysis purposes.
3. RESOURCE USAGE
(a) You shall not use the Service in a manner that consumes disproportionate or excessive resources or that degrades the performance or availability of the Service for other users.
(b) dbl9 reserves the right to impose or adjust rate limits, usage quotas, or other technical restrictions to protect the stability and performance of the Service.
4. REPORTING VIOLATIONS
If you become aware of any violation of this AUP, please report it to abuse@dbl99.de. We will investigate reported violations and take appropriate action.
5. ENFORCEMENT
5.1. dbl9 reserves the right to investigate any suspected violation of this AUP and to take any action it deems appropriate, including:
(a) Issuing a warning;
(b) Removing or disabling access to offending content;
(c) Suspending or terminating your Account and access to the Service;
(d) Reporting violations to law enforcement authorities.
5.2. dbl9 may suspend access to the Service immediately and without prior notice if it reasonably believes that a violation of this AUP: (a) poses an imminent threat to the security, integrity, or availability of the Service; (b) poses a risk of harm to dbl9, other users, or third parties; or (c) may expose dbl9 to legal liability.
5.3. dbl9 will endeavor to provide notice to Customer promptly after any suspension and will work with Customer to resolve the issue where practicable.
6. UPDATES TO THIS POLICY
dbl9 may update this AUP from time to time to reflect changes in law, technology, or our Services. We will provide reasonable notice of material changes. Continued use of the Service after the updated AUP takes effect constitutes acceptance of the changes.
